Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website www.andtusafari.com (the "Website") and the safari booking services provided by AndTu Safari ("AndTu Safari", "we", "us", or "our"). By accessing the Website, submitting a booking request, or making a payment, you ("the Client", "you") confirm that you have read, understood, and agree to be bound by these Terms.
AndTu Safari is a tour operator registered in Kenya, with its principal place of business at Rasi Gardens, Argwings Kodhek Road, Hurlingham, Nairobi, P.O. Box 100100-00100, Nairobi, Kenya.
If you do not agree with these Terms, please do not use our Website or services.
Definitions
• "Booking" means a request submitted by you for a safari package, tour, or related travel service offered by AndTu Safari.
• "Confirmed Booking" means a booking that has been accepted by us in writing and for which the required deposit has been received.
• "Services" means the safari tours, transport, accommodation, park entries, guiding, and related arrangements provided by AndTu Safari.
• "Travel Date" means the date on which your safari is scheduled to commence.
Booking Process
Bookings are submitted through the booking form on our Website or by direct correspondence with our team.
All bookings are subject to availability and to our written acceptance. A booking is only considered a Confirmed Booking once we have:
• issued a written booking confirmation; and
• received the required deposit in cleared funds.
You are responsible for ensuring that all information provided in your booking, including names (as they appear on passports), dates, contact details, and any special requirements, is accurate and complete.
Pricing and Payment
All prices are quoted in the currency stated on the Website or in your written quotation, and are valid only for the dates and conditions specified.
Prices include only the items expressly listed as inclusions in the relevant package or quotation. Items not listed (including, without limitation, international and domestic flights, visas, travel insurance, gratuities, beverages, personal expenses, and optional activities) are not included.
Deposit. A non-refundable deposit of thirty percent (30%) of the total booking price is required to confirm a booking, unless we agree otherwise in writing.
Balance. The balance of the total booking price is due no later than sixty (60) days prior to the Travel Date. For bookings made within 60 days of the Travel Date, full payment is due at the time of booking.
Payment method. Payments are processed through a third-party payment processor (such as Stripe). By making a payment, you also agree to the terms and conditions of the relevant payment processor. We do not store full payment card details on our systems.
If full payment is not received by the due date, we reserve the right to treat the booking as cancelled by you and to apply the cancellation charges set out in Cancellation by the Client.
Cancellation by the Client
Cancellations must be sent to us in writing at contact@andtusafari.com. The cancellation takes effect on the date we receive your written notice. The following cancellation charges apply, calculated as a percentage of the total booking price:
• More than 60 days before the Travel Date: full refund of all amounts paid.
• Between 31 and 59 days before the Travel Date: 50% of the total booking price is non-refundable; the remaining 50% will be refunded.
• 30 days or less before the Travel Date: no refund; 100% of the total booking price is non-refundable.
No refunds will be made for any unused services, early departures, late arrivals, or no-shows once the safari has commenced.
Refunds, where due, will be made to the original payment method, less any non-refundable third-party fees (including those charged by the payment processor, airlines, lodges, or park authorities).
Changes and Cancellation by AndTu Safari
We plan all safaris many months in advance. While we will use reasonable efforts to provide the Services as confirmed, we reserve the right to make changes to itineraries, accommodation, vehicles, guides, and routes where necessary, including for reasons of safety, weather, wildlife behavior, road conditions, lodge availability, or operational requirements.
Where a significant change is made before your Travel Date, we will notify you and offer, at our discretion: (a) acceptance of the change; (b) an alternative safari of comparable standard; or (c) a full refund of amounts paid for the affected portion.
In the rare event that we cancel a Confirmed Booking for reasons other than your default or a Force Majeure Event (Clause 9), we will refund all amounts you have paid to us. Our liability for cancellation is limited to such refund and we will not be liable for any other costs you may incur (including flights, visas, or insurance).
Travel Insurance
Comprehensive travel insurance is strongly recommended for all clients. Your policy should cover, at a minimum, trip cancellation and curtailment, medical expenses and emergency evacuation, personal accident, loss of baggage and personal items, and any adventure or wildlife activities included in your safari.
AndTu Safari does not provide travel insurance and accepts no responsibility for any loss or expense that would have been covered by an appropriate policy.
Passports, Visas and Health Requirements
It is your sole responsibility to ensure that you hold a valid passport, all necessary visas, and any required vaccinations or health certificates for entry into Kenya and any other country included in your itinerary.
We recommend that your passport be valid for at least six (6) months beyond the date of your return travel and that you consult your doctor or a travel health clinic regarding recommended vaccinations and anti-malarial precautions well in advance of travel.
AndTu Safari accepts no liability for any loss, expense, or refusal of entry resulting from non-compliance with passport, visa, or health requirements.
Flights and Independent Arrangements
AndTu Safari does not arrange international flights. You are responsible for booking your own international flights and for ensuring that arrival and departure times are compatible with the start and end of your safari.
Where your safari includes domestic or scheduled charter flights within Kenya or neighboring countries, those flights are subject to the terms, baggage limits, and conditions of carriage of the relevant operator. AndTu Safari acts only as an intermediary in respect of such flights.
Force Majeure
AndTu Safari shall not be liable for any failure to perform, or delay in performing, its obligations under these Terms where such failure or delay results from any event beyond our reasonable control (a "Force Majeure Event"), including but not limited to:
• acts of God, fire, flood, drought, earthquake, or other natural disaster;
• epidemics, pandemics, or public health emergencies;
• war, armed conflict, terrorism, civil unrest, riots, or strikes;
• government action, border closures, travel restrictions, or changes to visa or entry requirements;
• closure or restricted access to national parks, reserves, or conservancies;
• unusual or unpredictable wildlife behavior, animal-related incidents, or extreme weather conditions;
• failure of utilities, transport networks, or communications infrastructure.
If a Force Majeure Event prevents us from delivering the Services in whole or in part, we will use reasonable efforts to provide a suitable alternative. Where this is not possible, we will refund amounts received that have not been paid to third-party suppliers and that those suppliers refuse to refund. We will not be liable for any further compensation, costs, or expenses.
Conduct on Safari
You agree to follow at all times the lawful instructions of your guide, driver, lodge staff, and park rangers, and to comply with the rules and regulations of any park, reserve, lodge, or camp visited.
Safaris involve interaction with wild animals and natural environments and carry inherent risks. You participate at your own risk and are responsible for assessing your own fitness and ability to participate in the activities included in your itinerary.
We reserve the right to remove from a safari, without refund, any client whose conduct is, in our reasonable opinion, dangerous, disruptive, illegal, or seriously offensive to other clients, staff, or third parties.
Limitation of Liability
To the fullest extent permitted by law, AndTu Safari's total liability to you in respect of any Confirmed Booking shall not exceed the total amount paid by you to us for that Booking.
We will not be liable for any indirect, consequential, or special losses, including loss of enjoyment, loss of profit, or loss of opportunity.
AndTu Safari acts as an intermediary in respect of services provided by third-party suppliers (including airlines, lodges, camps, transport providers, and activity operators). We are not liable for any act, omission, default, or negligence of any such third party, except where such liability cannot be excluded under applicable law.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under applicable Kenyan law.
Photographs and Marketing Content
You consent to the use by AndTu Safari of any photographs or video recordings taken during your safari (including images in which you may appear) for marketing and promotional purposes, unless you notify us in writing prior to or during your safari that you do not consent. No payment will be due to you in respect of such use.
Complaints
If you have any complaint regarding the Services, you must inform your guide or our office as soon as reasonably possible during the safari, so that we have an opportunity to address the issue. Any complaint not resolved on the ground must be submitted to us in writing at contact@andtusafari.com within thirty (30) days of the end of your safari.
Use of the Website
All content on the Website (including text, images, logos, and design) is owned by AndTu Safari or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use any content from the Website without our prior written permission.
You agree not to use the Website for any unlawful purpose or in any way that may damage, disable, or impair its functionality or interfere with the use of the Website by others
Privacy
Your use of the Website and our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect and use your personal data.
Governing Law and Jurisdiction
These Terms and any contract formed under them shall be governed by and construed in accordance with the laws of the Republic of Kenya.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya, save that we may, at our discretion, agree to resolve disputes through mediation or arbitration in Nairobi.
Changes to these Terms
We may update these Terms from time to time. The version that applies to your booking is the version in force on the date your booking is confirmed. The current version is always available on our Website.
